It is BUT all you have to do to get it into your own device is to pay the royalty fees.
Sony can do two (2) things with these fees
1 - Make it HIGH so they get maximum earnings at the detriment of popularity since less people going to pay for it.
2 - Make it cheap OR FREE so that more people adopt it and basically brute force HD-DVD out of the market.
