    OK, speaking of Digicel. Any news regarding thier LTE expansion across the country?. A lot of areas outside the corporate area. Don't have LTE, so I don't know what's up with Thier deployment.

    RJR News understands that telecommunications company Symbiote Investments, which trades as Caricel, has been given a chance to convince the government not to revoke its licences.

    On April 10, the Government notified Symbiote that its licences had been yanked.

    However, Symbiote wrote to Technology Minister Dr. Andrew Wheatley urging him to reconsider the decision.

    Under the law, the company has 14 days from the date of notification during which to appeal the decision and provide evidence showing why the licences should not be revoked.

    Symbiote Shutdown Looms - Court Clears Way For Government To Revoke Telecommunications Licence
    The Supreme Court has cleared the way for the Government to revoke the telecommunications licence granted to Symbiote Investments Limited, which traded as Caricel Jamaica.

    In its ruling handed down last Friday, the court also rejected an application from lawyers representing Symbiote to appeal its ruling.

    In confirming the court's decision, Attorney General Marlene Malahoo Forte yesterday told The Sunday Gleaner that the Government will now move to complete the process, which was initiated based on a recommendation from the Office of Utilities Regulation (OUR).

    2).Appeal Court Temporarily Halts Caricel Shutdown
    The Court of Appeal has temporarily halted the shutdown of telecommunication company Caricel.

    In a ruling handed down today, the court gave Caricel’s parent company Symbiote Investment Limited, the go-ahead to challenge a decision by the Supreme Court to refuse its request for leave to seek judicial review of the government’s decision to revoke Caricel's telecommunications licences.

    "The Court of Appeal also made an order staying the implementation of the minister’s revocation order until the 14th of January," Patrick Bailey, one of the attorneys for Caricel, said in a statement.

    Lawyers for the government and Caricel are scheduled to appear before the Court of Appeal on January 14 for a hearing on whether the company’s application for leave should be allowed.

    Following the ruling by the Supreme Court nearly two weeks ago, Attorney General Marlene Malahoo-Forte announced that the government was moving to complete the process of revoking Caricel’s telecommunications licence.

    Caricel to shut down after Court of Appeal decision

    KINGSTON, Jamaica — The Court of Appeal on Friday denied Symbiote Investment Limited's application for a stay of the Minister of Science, Energy and Technology's decision to revoke its telecommunications licences, and set aside the order granting it permission to appeal.

    The Office of Utilities Regulation (OUR), in a statement today, advised that as a result of the decision, Symbiote, which operates as Caricel, is not authorised to own or operate a facility, nor is it permitted to provide telecommunications or other specified services, as defined in the Telecommunications Act, to the public.

    The Court's decision upheld the 2018 December Supreme Court decision to deny Symbiote's application for leave to apply for judicial review of the minister's decision.

    The Court of Appeal also refused the company's request that a temporary stay be granted until it makes an application for permission to appeal to the Privy Council.

    Base on a news item on TVJ, it would appear Caricel found a loophole in the telecom act which will allow them to continue to operate, according to their Company Secretary who was virtually in tears during the press conference, they will circumvent the revocation of their license, by transferring all assets, staff and customers to a new telecom provider called Xtra Net, which has a license to operate in Jamaica, thereby allowing them to continue to operate in Jamaica.
