Best Buy customers allegedly returned Galaxy Tab 10.1 tablets because they thought it was the iPad
Samsung was forced to release a bunch of documents it had been keeping under seal that show the likeness between its products and Apple’s. Examples outlined in the documents include comments from Samsung workers discussing similarities with Apple’s products, and reports Samsung got from retailer Best Buy that Samsung tablets were being returned because customers thought they were getting iPads. Samsung still has a pending motion to prevent all of this information from being included at trial.

all the apple device (ipod touch, iphone, ipad) i've seen look exactly the same(GUI), so anybody who mixes up a apple for another device (especially in a first world country where display models can be played with) must live under a rock and they just seeing the light of day

The patents are vaguely worded in a deliberate manner.
IF the patents are very specific it will leave room for competitors to maneuver around.
Apple and many other technology company realize that patent officers are sometimes struggling to keep up with the changes.
So they are often granted patents that are worded like "using a circular device to transport people, livestock and materials from one place to the next"
because the patent system has not been updated to keep up with technology (its over 100 years old) the companies are using the court systems as a weapon (they don't really want justice) to slow down competittors or destroy them.
The courts all a over the world are being abused.
Frankly the patent system needs a major future proof over haul.
AS for Samsung... they knew this was coming... the resemblance to the iPhone no matter how small is going to be challenged.
I remember when Apple sued Microsoft over the look and feel of windows 2.0 and 3.0
It is the same thing all over again.
This time Apple isn't suing MS... they are suing Google and the story will play itself out in very much the same way.
Eventually Google will surpass apple and soon you will see the second stage of history repeating itself... but this time... Steve is not there to bail them out.
