C&W concerned over today’s Supreme Court ruling |

Cable & Wireless Jamaica is today expressing concern over the potential adverse effects that today’s Supreme Court ruling in relation to call terminations rates will have on the Telecoms industry, especially on new entrants.
In May of 2002 the Office of Utilities Regulation (OUR) issued certain rulings regarding interconnect charges to be made and amounts to be collected for calls to mobile customers from overseas callers . These rulings changed the basis on which these amounts were to be apportioned between Cable & Wireless and mobile carriers. These rulings prompted a law suit by Digicel and one by the OUR.
In July 2002, the Supreme Court ordered that pending the trial of those lawsuits, Cable & Wireless was to retain the difference between the sums payable under the old basis and those payable under the new basis.
The hearing of the lawsuits was concluded in February of 2003 and Mr. Justice Dukharan today handed down his decision in favor of Digicel, the effect of which is that the new basis of calculation, that had been approved by the OUR, is not to come into effect.
Cable & Wireless has been holding these funds in an appropriate account and will pay over the amounts now due in accordance with the ruling by the Court. |
